The only female in Parliament from the Western Region, the adorable Dorcas Affo-Toffey, representing the Jomoro Constituency has been ordered by a High Court in Sekondi to provide official documents to prove she is not an Ivorian citizen as at the time she filed forms to become a legislator in Ghana.
Per the Ghanaian constitution, persons who hold allegiance to any other country cannot contest to enter Parliament.
The Jomoro MP was dragged to court by one concerned citizen by name Joshua Emuah Kwofie, who has accused Dorcas Affo-Toffey of having dual citizenship of both Ghana and the Republic of Côte d’Ivoire and therefore she is not qualified to hold herself as a Member of Parliament in Ghana.
The petitioner therefore prayed the court to declare the 2020 parliamentary victory of Dorcas Affo-Toffey as null and void.
The MP however told the High Court that though once-upon-a-time, she had the citizenship of the Republic of Côte d’Ivoire, she renounced that citizenship and that as at the time she became a Parliamentarian in Ghana, she was not having dual citizenship or having her allegiance to any other country apart from Ghana.
The Sekondi High Court on Tuesday June 22, 2021 ordered that since the MP, Dorcas Affo-Toffey, had said she had renounced her Ivorian citizenship, it would be fair and appropriate to allow her to provide the requisite documents to prove her claim.
The Judge, Justice of the Sekondi High Court, Dr. Richard Osei Hwere, therefore gave the defendant a 10-day ultimatum to provide to the Court the necessary documents to back her claim.
Dorcas Affo-Toffey is in Parliament on the ticket of the National Democratic Congress (NDC). The party has given clear indications it would appeal for a stay of execution against the Tuesday June 22 ruling of the Sekondi High Court and also appeal against the order itself.
The 10-day ultimatum ends on July 1, 2021.
