Last Chance For Wisa
The Accra Domestic Violence and Gender Based Court has given Hiplife artiste Eugene Ashe the last opportunity to open his defense in the ongoing case against him.
The artiste was due to open his defense this morning following the dismissal of a no case application filed by his lawyers.
When the case was called, Wisa who was in court told the judge that his lawyer, Jerry Avenogbor was involved in an accident on his way to court this morning.
He stated that Mr. Avenogbor as at the time the matter was due for hearing was at the police station.
Mrs. Abena Oppong Adjin-Doku however adjourned the hearing saying “Tell your lawyer the case has been adjourned. With or without him, you will open your defense tomorrow”.
Jerry filed for no case on August 30, 2017 arguing that Wisa has no case to answer in respect of the matter before the court.
Wisa’s lawyer believed the prosecution, led by Inspector Judith B. Asante have no case against his client.
The court subsequently dismissed the motion ordering Wisa to open his defense February 5 this year.
The judge in a ruling held that a prima facie case has been established against the artiste.
In the view of the court, the prosecution has proved that there is a prima facie and that the burden lies on the accused to tell his story.
However, on the said day, Wisa returned to court asking for more time to open his defense.
Speaking through his lawyer, the “Ekiki Me” hit singer claimed he requires two more weeks to open his defense.
According to the lawyer, the person in custody of their key evidence is outside the country.
“We want the court to give us two weeks so that we show up in court with the main tool to aid the court determine the matter effectively” he argued.
He said it is important for the court to grant the request of the defense as prescribed by the rules of natural justice which requires that the other party must also be heard in the case.
Avenogbor assured the court that at the next court date the hearing would “move smoothly” without any further hitches.
He said his client would call two witnesses.
Wisa is standing trial for allegedly showing his manhood during a live performance on December 24, 2015 during the ‘December 2 Remember’ event at the Accra International Conference Centre (AICC).
A video of the artiste stripping and rubbing what was believed to be his manhood against his female dancer on stage was put on social media, compelling his management to apologise for what it described as the artiste’s “rash and irresponsible behaviour”.
