The two teenage Ghanaian boys currently in court on allegations that they killed a 10-year-old friend ostensibly to use his body for money rituals have once again been refused bail application when they appeared in court.
The Magistrate, Samuel Adjei, who presided over the case at the Ofankor District Court said the court does not have jurisdiction to grant bail at this stage except the trial court, which is the High Court.
Lawyer for the accused persons, Samuel Atuah argued that the two have been in police custody for some time now and that the constitution is clear that an accused person is innocent until proven guilty so the court should consider that provision to grant them bail.
Arguing against the bail was the Prosecutor handling the case, Chief Inspector Ernest Agbo, who said the two should be in police custody while investigations continue.
He explained that it was even in the interest of the accused persons that they are kept in police custody for their own personal safety, at least until the investigations are concluded.
The magistrate, after listening to the pleas, refused the bail anyway. He told the Prosecutor to see to it that the investigations are done with some urgency, especially in investigating the correct ages of the accused persons.
He further ordered the Prosecution team to hurry with the preparation of the docket to the Attorney General for advice.
The two murder suspect Felix Nyarko said to 15 and Nicholas Kini also said to 17 were first in court on Tuesday April 6, but were asked to be put on remand in police custody and expected to make a second appearance in court on April 20, 2021.
