Take Me To High Court! …ACP Agordzo Petitions A-G
Lawyers of the embattled former Director of the Transformation Office of the Ghana Police Service, ACP Dr. Benjamin Agordzo has petitioned the Attorney-General, Gloria Akuffo over the continuous arraignment of their client before the Kaneshie District Court in Accra.
“The District Court has no jurisdiction to try the offence for which my client is being held by the Bureau of National Investigations (BNI), as such, it is not a court of competent jurisdiction within the meaning of article 14 of the Constitution, 1992.”
This was contained in a three page petition authoured by lawyer for the accused Martin Kpebu dated November 6, 2019 sighted by THE NEW PUBLISHER.
On Friday the Kaneshie District Court rejected arguments by ACP Agordzo’s lawyers that it has no jurisdiction to hear the charges of abetment to commit crime namely treason felony preferred against the senior police officer.
But in the view of the petition copied the Director of the BNI and the Minister State in Charge of National Security at the Office of the President in Accra the AG’s office is aware, the Supreme Court has held that the court before whom the suspect is brought must be a court that has jurisdiction to try the offence for which the suspect or accused person is being held.
The Senior Lawyer is sure the decision by the BNI to bring the suspect before a court that has no jurisdiction to try the offence he is suspected of is a deliberate attempt to infringe upon his constitutional rights.
Mr. Kpebu added” “we therefore pray your office to instruct the BNI to bring my client before the High Court; to enable him request for bail.
